How much of this game do you think is copyrighted or exactly what is copyrighted I should say ?
You can't copyright historical units or scale therefore the miniature sculpts are obviously fair game but as far as mechanics go cardlayout , special abilities , unit stats ,terminology , rules etc how much of that is protected?
HBG does basically axis and allies games that aren't officially axis and allies , 1936, 1939, operation barbarossa etc. That you use the same sculpts , mechanics etc for. It makes me curious how similar one could make a WAS game to continue the line or be a successor without crossing the line, something with miniatures , maps, cards, tokens etc as opposed to just cards.
The forum decks are basically successors but is that allowed because a profit isn't happening or because the card layout is different?
It could always be a spiritual successor if copyright did get in the way, an example being the very popular PC game Cold Waters, which is a self-describe spiritual successor to Red Storm Rising.
Thanks to the Chinese you can't copy-write game mechanics just artwork, trademarked material, style and design.
If you change the graphic design, artwork and style then you should be OK. Just look at all the cheap ripoff versions of Battleship there is on the market nowadays.
HBG does their own take on axis and allies usually as a bit deeper though using even the same pieces and rules they in the past created a mat for WAS would be interesting to see them sort of rerelease the game under their own banner.
Two things: 1. As of this year, WOTC still holds the copyright for those areas that can be copyrighted. Most of WaS isn't covered by this copyright but that doesn't mean the game is up for grabs. 2. Anything that is trademarked by WOTC (and I haven't checked to see if there is anything) is strictly hands-off.
